By accessing our website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Nature of Our Products – Made-to-Order Jewelry

Giftivax specializes in premium, made-to-order jewelry.

All products are:

  • Individually crafted after an order is placed
  • Not mass-produced or pre-stocked
  • Created specifically for each customer

Due to the customized and made-to-order nature of our products, certain restrictions apply regarding cancellations and returns.

3. Production & Delivery

Estimated delivery timeframe: 2–5 business days

This timeframe includes order processing, production, and shipping.

Important notices:

  • Delivery timeframes are estimates only and are not guaranteed.
  • Giftivax is not liable for delays caused by shipping carriers, customs authorities, force majeure events, or circumstances beyond our reasonable control.
  • Customers are solely responsible for providing accurate shipping details at checkout.

Tracking information will be provided once the order has been dispatched.

4. Personalization & Customer Responsibility

For personalized products, you acknowledge and agree:

  • All submitted names, dates, messages, and other custom details are your responsibility.
  • Giftivax shall not be liable for errors, misspellings, or inaccuracies submitted by the customer.
  • Once production has commenced, modifications cannot be made.

Customers are strongly advised to review all personalization details carefully before completing purchase.

5. Pricing & Payment Terms

All prices displayed on www.giftivax.com are in United States Dollars (USD).

We reserve the right to:

  • Modify pricing at any time without prior notice
  • Correct pricing errors
  • Cancel orders arising from pricing inaccuracies

Payments are securely processed via Shopify’s encrypted checkout system. Giftivax does not store credit card information.

6. Order Acceptance & Cancellation Policy

All orders are subject to acceptance and availability.

Due to immediate processing:

  • Cancellation or modification requests must be submitted within 12 hours of purchase.
  • After production begins, orders cannot be canceled, refunded, or modified.

Giftivax reserves the right to refuse or cancel any order at our sole discretion.

7. Returns, Refunds & Replacement Policy

Because all items are made-to-order, Giftivax maintains a strict return policy.

Refunds or replacements are granted only under the following circumstances:

  • The item arrives damaged
  • There is a verified manufacturing defect
  • An incorrect item was delivered

To initiate a claim:

  • Contact us at giftivax@gmail.com within 7 days of confirmed delivery
  • Provide clear photographic evidence of the issue

The following are not eligible for refund:

  • Incorrect size selection
  • Personalization errors submitted by the customer
  • Change of mind or buyer’s remorse
  • Shipping delays outside our control

Where a claim is approved, Giftivax will provide a replacement product at no additional cost. Refunds, if granted, are issued at our sole discretion.

8. Intellectual Property Rights

All materials displayed on www.giftivax.com — including but not limited to product designs, images, graphics, branding, logos, descriptions, and website content — are the exclusive intellectual property of Giftivax.

Unauthorized reproduction, distribution, modification, or commercial use is strictly prohibited.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Giftivax shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, or data
  • Delays caused by third-party service providers

In all circumstances, our total liability shall not exceed the total amount paid by the customer for the specific product giving rise to the claim.

10. Force Majeure

Giftivax shall not be held responsible for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, transportation disruptions, governmental actions, labor disputes, or supply chain interruptions.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with applicable international e-commerce and consumer protection laws.

Any disputes arising under these Terms shall be resolved in accordance with applicable legal procedures.

12. Amendments

Giftivax reserves the right to update or modify these Terms at any time without prior notice. Continued use of the website following changes constitutes acceptance of the revised Terms.
